Developing a Groundwater Strategy for the Central Valley Region

Central Valley Regional Water Quality Control Board adopted Resolution No. R5-2008-0181 in support of Developing a Groundwater Strategy for the Central Valley Region. The resolution directs staff to develop a long-term strategy that will identify high priority activities, recognize the water boards core responsibilities and existing commitments; and build on existing processes. The Central Valley Water Board recognizes the importance of a collaborative planning process and will be doing outreach with stakeholders throughout the development of this strategy.

 eRulemaking Enhances Regulations.gov for Access to Federal Regulations

   The eRulemaking Program has launched a significant upgrade to the Web site that provides one-stop, public access to information related to current and forthcoming regulations issued by the federal government. Enhancements to www.regulations.gov  include improved search capabilities, new navigation tools, and easier access to areas for the public to provide comments on proposed regulations. The Environmental Protection Agency is the managing partner of the inter-agency eRulemaking Program, which operates www.regulations.gov.   

   Visitors to www.regulations.gov  can now streamline search results with date ranges, select specific U.S. government departments or agencies, and view results by docket or file folder. Other changes include interactive icons and links to common user tasks that pre-populate search fields to help users find regulations and comments. The Web site also provides quick access, simplified navigation and additional information sharing, such as social bookmarking and RSS feeds by specific government departments or agencies.

   These enhancements were previewed publicly on Regulations.gov Exchange, an online forum featured in the White House Open Government Initiative. From May 21 to July 21, 2009, the public was able to explore proposed new designs and features, provide comments, and engage with other site visitors and the eRulemaking Program staff.

   Regulations.gov helps individuals provide written comments to agencies before regulations are finalized. The site supports more than 160 federal agencies accounting for 90 percent of all federal rulemaking production. On average, federal agencies, departments, and commissions issue 8,000 regulations annually. To date, the public can access more than 2 million documents on regulations.gov, and in the first half of 2009, visitors to the Web site submitted more than 200,000 comments on new or existing regulations.

EPA Extends the Compliance Dates for all Facilities and Establishes New Compliance Dates for Farms Subject to Spill Prevention Control and Countermeasure (SPCC) Rule

   The U.S. Environmental Protection Agency (EPA) has extended the compliance date for all facilities and established a new compliance date for farms subject to the oil Spill Prevention Control and Countermeasures (SPCC) regulations.  This final rule is part of EPA’s multi-phased strategy to address concerns with the SPCC regulation.  Specifically, this SPCC rule amendment extends the dates by which the owner or operator of an SPCC regulated facility or farm must prepare or amend and implement an SPCC plan to November 10, 2010. 

   These amendments do not remove any regulatory requirement for owners or operators of facilities in operation before August 16, 2002, to maintain and implement SPCC plans in accordance with the SPCC regulations then in effect.  Such facilities are required to maintain their plans until the applicable date for revising and implementing their plans under the new amendments.  More information:   http://www.epa.gov/oem/content/spcc/index.htm

Careers in Manufacturing Program receives Excellence in Education Award!

Modesto Chamber of Commerce has named Careers in Manufacturing as the recipient of its 2008 Excellence in Education Award. CIM is a ground breaking program unique to California’s San Joaquin Valley with origins in Modesto. CIM is a partnership between the Manufacturers Council of Central Valley, Stanislaus Economic Development & Workforce Alliance and Stanislaus Partners In Education (SPIE), in strong collaboration with Modesto Junior College, high schools throughout Stanislaus County and local employers. It was started in Stanislaus County as a pilot program with plans to deploy throughout the San Joaquin Valley if successful.

Now in the fifth year, CIM has brought new awareness of exciting and well-paying manufacturing career opportunities to students, parents, educators and the workforce development professionals.  It has provided close to 200 high school graduates with employment; the manufacturing industry with motivated workers; and has increased the number of students registering for Modesto Junior College’s Technical Education courses.  One of the key components of CIM has been to develop partnerships and strengthen linkages between employers, educators, workforce development professionals and job seekers; all are involved and at the table working together to increase the educational and skill levels of the local workforce. TRU Registration Deadline is Friday, July 31--Friday, July 31, 2009, is the deadline for registering California-based transport refrigeration units (TRU) and TRU generator (gen) sets with the California Air Resources Board (ARB). California-based TRUs and TRU gen sets are TRUs and TRU gen sets equipped on trucks, trailers, shipping containers, or railcars that a reasonable person would find to be regularly assigned to terminals within California.
    You may register your TRUs and TRU generator sets online at the Air Resources Board Equipment Registration (ARBER) system. ARBER may be accessed using your web browser at:

. Registration is free, but don't let that fool you. Enforcement will begin in August and. For assistance call the TRU Help Line at 1-888-878-2826.
  Don't let the fact that registration is free, lull you into thinking the ARB isn't serious about enforcement. They have said, "Please be aware that enforcement of the TRU registration requirement begins August 2009. Citations will be issued to all noncompliant TRU owners and operators. Penalties will be up to $500 per nonregistered, California-based TRU but can possibly be more for serious cases. Ticketed TRU owners will also be subject to full audits by ARB for all applicable diesel engine regulations."
   
Additionally, all model year 2002 or older TRU engines, must be fully compliant with the in-use standards by December 31, 2009. Since lead times can be three to four months and may change with supply and demand, ARB recommends that orders for compliance technology be placed by September 1. ARB has publicly stated that beginning January 2010, all noncompliant equipment will be cited and a penalty up to $1,000 per unit will be assessed, but can possibly be more for serious cases. Compliance would also be required within 60 days.

AB 32 Early Action Measure: Mandatory Commercial Recycling-- workshop is July 20 and will be webcast (follow the link below). Agenda and White Paper. BACKGROUND: The Air Resources Board scoping plan for the California Global Warming Solutions Act of 2006 (AB 32, Núñez, Chapter 488, Statutes of 2006) was adopted with a Mandatory Commercial Recycling measure (PDF) Because the commercial sector is not directly subject to the requirements of Integrated Waste Management Act of 1989, (AB 939), to divert waste from landfills, AB 32 directs the California Integrated Waste Management to develop a mandatory commercial recycling program. CIWMB has initiated the  informal rulemaking process while developing the mandatory commercial recycling measure. Informal stakeholder workshops are being held in July and August 2009. The first workshop was held July 20 and will be webcast (follow the link below). Agenda and White Paper.  The formal rulemaking process should begin January 2010 with completion of the regulation by the end of 2010 or early 2011. The California Air Resources Board (ARB) maintains information about the implementation process and timelines for all of the scoping plan measures.

ARB Offers Free Training on Heavy Duty Diesel Vehicle Regulation-- Air Resources Board has a new regulation to reduce emissions from existing off-road diesel vehicles used in California in construction, mining, and other industries. The regulation requires fleet owners to report to ARB and then to retrofit, repower, or replace their off-road diesel-fueled vehicles gradually over the next decade. http://www.arb.ca.gov/training/courses.php?course=504

To assist fleet owners with their compliance efforts, ARB staff is conducting a series of training seminars on the regulation. These sessions provide an in-depth presentation of the regulation and how to comply, as well as information about grant opportunities. This training will repeat the material covered in the first three rounds of training seminars conducted July 2008 through March 2009 and will also cover recent regulatory changes mandated by the State Legislature. Air District Workshop and Rule Schedule filled--Over the next few weeks, the San Joaquin Valley Unified Air District will hold a number of workshops and accept comments for rules under development. The rules range from the employer-based trip reduction rule, to the small boiler (.75-2 mm/btus/hr, rules on adhesives, coating of metal parts, and more. Healthy Air Living-- The San Joaquin Valley Unified Air Pollution Control District held a series of Healthy Air Living Business Summits  for early June 2009.  According to the district, this is "a great way for your business to become a part of Healthy Air Living and the air quality solutions in the Valley!" When is No News Not Good News?
Do you think you're off the hook for reporting GHG emissions because you haven't received an official letter from the California Air Resources Board. Don't throw a party just yet....not everyone who should be notified has been notified. If you are concerned that your firm may be over the CARB mandatory reporting threshold of 25,000 metric tonnes CO2 equivalent, or fall into one of the mandatory reporting categories, but haven't received formal notification by the agency, there are three steps to take that will keep your company on the right side of CARB on this issue. More than 3,000 high school seniors, their parents, teachers and families heard about the exciting career opportunities in manufacturing as part of the fourth year of Careers in Manufacturing: High School Partnership. The program is still in the pilot phase in Stanislaus County. This year, nearly 600 seniors filled out job applications. Of that, about 300 were deemed serious, because they completed the two-page pre-application screening form which employers use to determine who will be asked to go through their specific application process. From the 300, approximately 160 were considered "viable" due to sufficient work keys scores, age, and other factors. So far, 93 have been offered employment at 36 different companies. Some students worked seasonally, others are fulltime, year-round. AB 32 Forum * How Climate Change Laws Will Impact Valley Businesses & Families
California is moving aggressively to implement AB 32 (Global Warming Solutions Act) and other policies to attack global warming. This Forum brings together key local and state experts to brief valley businesses, elected officials and civic leaders on the costs and benefits of California’s climate change law. MCCV/CLFP Presents Boiler Rule Compliance Alternative to Air District
Following up on their November comment letter (November letter), MCCV and CLFP have submitted a more detailed letter outlining the technical, logistical and economic issues associated with implementation of a one-size-fits-all 5 ppmv emissions limit on boilers >20 MMBtus/hour . The letter also includes a series of compliance options to help ensure that the district can meet its fast track goals for clean air compliance ahead of the regulatory commitments under the 8-Hour Ozone Plan and draft PM 2.5 Plan. The letter reiterates the committment of MCCV and CLFP members  to doing their part to continue to clean up the valley's air in a manner which is economically reasonable for the benefit of all valley residents.

Are You Prepared to Put Your Best Carbon Footprint Forward?
California's "Global Warming Solutions Act," know as AB 32, coupled with other national and international regulatory GHG measures, has the potential to directly and indirectly impact nearly every business and manufacturing company in the state as early as next year.  To provide information to its members and other interested businesses, the Manufacturers Council of the Central Valley partnered with California League of Food Processors, the Wine Institute and the Agricultural Council of California to sponsor a workshop entitled:  Climate Change and the Food Processing & Winery Industries:  How to Comply With the AB 32 Regs and Cope With the Coming Low-Carbon Business Environment. Is your forklift fleet ready for inspection?
Companies had until last November to complete their forklift fleet inventories and while the inventories do not need to be submitted, they do need to be available to ARB and district inspectors. You can learn more at the February 20 MCCV Meeting. As background, California, in working to attain federal ambient air quality standards for ozone has adopted tough new regulations for hydrocarbons and oxides of nitrogen as part of the State Implementation Plan which impact spark ignited off road engines of >25 brake horse power. Typical applications that use LSI engines include forklifts, specialty vehicles, airport service vehicles, large turf care equipment, portable generators, and a wide array of other agricultural, construction, and general industrial equipment. Stumped on where to find information on federal regulations? Try www.RegInfo.gov, a United States Government website produced by the Office of Management and Budget (OMB) and the General Services Administration (GSA).  GSA's Regulatory Information Service Center (RISC) is responsible for gathering and publishing information on Federal regulations through the semiannual Unified Agenda of Federal Regulatory and Deregulatory Actions .

Some recent items of interest include: 

  • SPCC Plans-EPA  is considering various revisions and exclusions to the oil pollution prevention planning rules at 40 CFR 112. A final rule is targeted for October 2008.
  • NESHAP (industrial, commercial and institutional boilers)-The administration is developing emission standards for these area sources. These area source standards can require control levels that are equivalent to either maximum achievable control technology (MACT) or generally available control technology (GACT). A final rule is targeted for December 2007.
  • Potential to Emit-This rulemaking rule would revise the definition of the term "potential to emit" (PTE) used in numerous Clean Air Act regulations to determine the applicability of major source requirements. The revisions would affect the New Source Review, NESHAP, and Title V programs.  The regulatory amendments will address enforceability issues raised in court decisions by the D.C. Circuit regarding the types of limitations allowed to be used in a source's PTE calculations.
  • NSPS Boilers-EPA is granting reconsideration on the recently finalized boiler NSPS amendments. Issues under reconsideration include the appropriate averaging time for facilities using particulate matter continuous emission monitoring systems (PM CEMS) and appropriate parametric monitoring requirements for facilities without PM CEMS.
  • CPMS Performance Specs-EPA is considering changes to requirements for continuous parameter monitoring systems.

The State Water Board has identified a need for statewide uniform compliance schedule provisions and consistency in implementation of these provisions in the state's NPDES permit program. The State Water Board directed staff to develop a statewide policy that would meet this need and make better use of both stakeholder and Water Board resources by providing clear guidance on the appropriate use of compliance schedules in NPDES permits. A workshop is scheduled for Feb. 20, 2008. The State Water Board will hold a public hearing on March 18, 2008 to receive comment and to consider adopting a proposed statewide Policy for Compliance Schedules in NPDES Permits (proposed Policy).

    The California climate change initiative, uncertainty regarding energy price trends, and intense competition from foreign-based food processors will necessitate quantum improvements in energy/resource efficiency for California firms to remain competitive in the long term.     Hilmar SEP Sets up Web Site
    On March 16, 2006, the Central Valley Water Quality Control Board and the Hilmar Cheese Company entered into a settlement agreement regarding Administrative Civil Liability Complaint No. R5-2005-0501. This settlement  required Hilmar to fund a Supplementary Environmental Project (SEP).  The SEP is a study of the management of salinity in wastewater in the California food processing industry.     ARB Forwards Valley's 8-Hour Ozone Plan to EPA; calls for more work in valley
    ARB calls for more measures to meet Valley ozone standard sooner: ARB approved a staff report endorsing the effectiveness of the San Joaquin Air District's regulatory programs while at the same time making a number of recommendations aimed at reaching the federal ozone deadline by 2017.     California, in working to attain federal ambient air quality standards for ozone has adopted tough new regulations for hydrocarbons and oxides of nitrogen as part of the State Implementation Plan which impact spark ignited off road engines of >25 brake horse power. Typical applications that use LSI engines include forklifts, specialty vehicles, airport service vehicles, large turf care equipment, portable generators, and a wide array of other agricultural, construction, and general industrial equipment.

    SJV Air District Offers Incentive Grants for LSI's (like forklifts)!
    Are you retrofitting your large LSI off road engines such as forklifts to meet the new state requirements? You may be able to qualify for incentive funding for the second tier, but you need to take action now. The Air District has two different grant programs to help individuals, businesses and organizations improve Air Quality in the San Joaquin Valley.     Central Valley Board issues Management Guidance for Salinity in WDRS
    The Central Valley Regional Water Board has issued a guidance document for its staff regarding the application of salinity policy to WDR's and NPDES permits in order to reduce salinity in effluent waters.  It is recommended that most WDR holders to identify their sources of salt, develop salt control alternatives, and implement salinity control measures as soon as possible.     California Water Plan Update 2009 Sets Outreach Workshop in Stockton, August 13 -- DWR, in cooperation with other State agencies, is holding a regional public workshop to gather and share information about the California Water Plan Update 2009. The workshop will be held in Stockton on August 13, 2007 from 10:00 a.m. to 3:00 p.m., including a working lunch. The Natural Resources Institute and the School of Engineering and Computer Science, University of the Pacific will be hosting this workshop at the Stockton campus located at 3601 Pacific Avenue Stockton, California.
